The Abuja Division of the Court of Appeal has dismissed an application by the suspended Chief Justice of the Federation Walter Onnoghen seeking to stay proceedings on charges of false asset declaration brought against him by the Federal Government at the Code of Conduct Tribunal.
Justice Abdul Aboki leading a three-man panel on Wednesday, held that the court could not interfere as the charges before the CCT were criminal in nature.
Aboki held that there was no evidence to support granting a stay of proceedings. “A court has inherent jurisdiction to grant stay of proceedings where it is certified that enough evidence has been given for such,” he said.
“An order cannot be made in vacuum.”
